Child Support Duration in Texas

Texas law states that a court may require either or both parents to support a child throughout their adolescent life. If the court deems the child to be either physically or mentally disabled, the child may receive support indefinitely. Otherwise, the child will stop receiving support when a qualifying event occurs.

Qualifying events may include, but are not limited to, the following:

  • The child graduates from high school
  • The child emancipates by marriage
  • The child’s disability ends
  • The child turns 18
  • The child dies

Who Pays Child Support?

In most divorce cases, the court orders the noncustodial parent to pay child support. This does not mean that the other parent does not need to provide financial resources for their child. The law assumes that the custodial parent is continually paying to support the child in a direct manner.

The noncustodial parent makes payments to the custodial parent to help him or her with the costs of raising the child. The amount of the child support payments is based on a percentage of the noncustodial parent's income, as well as numerous other factors. Any parent is free to pay more than the court requires, but they may not pay less.
